SB1753 by Lucio (Relating to positive behavioral interventions and supports for students enrolled in public school who receive special education services.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Education Code to specify that it is the policy of the state that each school district to the maximum extent possible provide functional behavioral assessments to a student whose behavior interferes with that or another student's ability to learn. The bill would require that districts provide positive behavioral interventions that meet certain specified guidelines and would prohibit certain disciplinary practices. The bill would also specify that positive behavioral interventions may be an allowable district staff development training topic and would specify certain knowledge that a person offering such training must possess.

The bill would take effect immediately if passing with the necessary voting margins, or September 1, 2017.

The Texas Education Agency reports that the bill can be implemented with existing agency resources.

The Texas Education Agency reports that the bill would have a fiscal impact to school districts to the extent that they have to change existing policies and procedures regarding professional development and training to implement the bill; such impact may be significant for certain districts.
