LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION

May 8, 2017

TO:
Honorable John T. Smithee, Chair, House Committee on Judiciary & Civil Jurisprudence

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
SB1763 by Zaffirini (Relating to the procedures of the State Commission on Judicial Conduct.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to require the State Commission on Judicial Conduct to include certain information specified in the bill in its annual report, would require the Commission to provide online access to information about each adjudicated complaint that resulted in a sanction being issued and the results of that complaint, and would require certain notices and disclaimers to appear on the Commission's website. The bill would require notice of the status of a complaint only when there is a change in status, would require the Commission to publish guidelines for punishment that is proportional to any misconduct, and would require the Commission establish a timeline governing investigation of any complaint. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
