No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code relating to the issuance and possession of a handgun license to certain federal and state attorneys. The bill would also waive any fee required for the issuance of an original, duplicate, or renewed license to carry a handgun under Chapter 411, Subchapter H, Government Code, for an applicant who is a United States attorney or an assistant United States attorney or who is an attorney elected or employed to represent the state in the prosecution of felony cases.

The bill would also amend the Penal Code to clarify that offenses governed by sections 46.02 and 46.03 of the Code are not applicable to a United States attorney or an assistant United States attorney. This analysis assumes the provisions of the bill addressing felony sanctions for criminal offenses would not result in a significant impact on state correctional agencies.

Due to the limited number of persons affected, it is anticipated that the addition of certain federal and state attorneys would not have a significant impact on revenues. It is assumed that the costs to administer the provisions of the bill could be absorbed within existing resources.

The bill would take effect September 1, 2017.
