SB1870 by Zaffirini (Relating to county prohibition of the possession of glass containers within the boundaries of a state-owned riverbed; creating an offense.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to extend an existing restriction on the possession of glass containers within the boundaries of certain state-owned riverbeds. The bill would authorize, but not require, counties not covered under existing statute to prohibit these containers.  A violation would be a Class C misdemeanor.

This bill would take effect September 1, 2017.

Local Government Impact

A Class C misdemeanor is punishable by a fine of not more than $500.  Costs associated with enforcement and prosecution could likely be absorbed within existing resources.  Revenue gain from fines imposed and collected is not expected to have a significant fiscal impact.  In addition to the fine, punishment can include up to 180 days of deferred adjudication.

According to the Texas Association of Counties, there is not anticipated to be a significant fiscal impact to counties from the bill.
