No significant fiscal implication to the State is anticipated.

The bill would amend the Insurance Code relating to requirements for updating information provided by certain health benefit plans through the Internet. The bill requires the Texas Department of Insurance (TDI) to investigate the health benefit plan issuer's compliance with regards to provider directories. The bill requires TDI to collect an assessment sufficient to cover all expenses attributable to the provider directory investigations, and deposit the assessment to the TDI operating fund.

Based on information provided by TDI, Texas A&M University System Administration, The University of Texas System Administration, and Health and Human Services Commission, this analysis assumes that the duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources. Due to the self-leveling nature of the TDI operating fund, this analysis assumes that TDI would adjust the assessment to account for any additional costs resulting from the implementation of the bill.

Based on information provided by Employees Retirement System, the agency could have costs depending on the amount and scope of investigations conducted that the state health plan would be required to fund; however based on LBB analysis, it is not anticipated to be significant.
 
This legislation would do one or more of the following: create or recreate a dedicated account in the General Revenue Fund, create or recreate a special or trust fund either with or outside of the Treasury, or create a dedicated revenue source. The fund, account, or revenue dedication included in this bill would be subject to funds consolidation review by the current Legislature.
