IN RE:
SJR50 by Whitmire (Proposing a constitutional amendment authorizing the denial of pretrial release of a person accused of a noncapital offense if necessary to ensure the person's appearance in court and the safety of the community and the victim of the alleged offense.), As Introduced
No significant fiscal implication to the State is anticipated, other than the cost of publication.
The cost to the state for publication of the resolution is $114,369.
The resolution would amend the Constitution to deny pretrial release if a judge or magistrate determines that requiring bail and conditions of release are insufficient to ensure the defendant's appearance in court or the safety of the community or the victim of the alleged offense.
This resolution would be submitted to voters at an election to be held on November 7, 2017. If the resolution passes then the constitutional amendment would take effect upon certification of the election by the Governor and the Secretary of State.
