CRIMINAL JUSTICE IMPACT STATEMENT

85TH LEGISLATIVE REGULAR SESSION

April 29, 2017

TO:
Honorable Dan Huberty, Chair, House Committee on Public Education

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB2872 by Burns (Relating to the authority to issue an arrest warrant or citation for certain Class C misdemeanors committed by certain children on school property.), As Introduced

The provisions of the bill addressed by this analysis would amend the Education Code as it relates to the authority to issue an arrest warrant or citation for certain Class C misdemeanors committed by certain children on school property. Under the provisions of the bill, certain officers would be permitted to issue an arrest warrant or a citation to an individual who is alleged to have committed certain Class C misdemeanor offenses if the individual is alleged to have committed the offense while in a disciplinary alternative education program.

A Class C misdemeanor is punishable by a fine not to exceed $500.

This analysis assumes the provisions of the bill would not result in a significant impact on the demand for state correctional resources.
