The bill would allow a judge to place certain state jail felons under community supervision for a period not to exceed 270 days with the conditions the individual submit to confinement within a state jail facility and participate in an educational and vocational training program. Under the provisions of the bill, the capacity for the pilot program would be 180 participants (four locations serving a maximum of 45 individuals each). After removing individuals who were not eligible for the program based on the provisions of the bill, those admitted into state jail had an average sentence length of 10 months and an average of four months credit in county jail at admission. Under the provisions of the bill, individuals would be allowed to have time served in a county jail credited against the term of confinement in a state jail facility. Based on the analysis of historical data, this analysis assumes the individuals subject to the bill's provisions would be placed directly under felony community supervision since the average county time credit awarded to state jail felons was approximately four months. The provisions of bill apply only to those who receive a sentence of confinement in a state jail on or after September 1, 2019. Estimated populations are based on pilot program capacity and assume sentencing patterns, county jail time credit policies, and release policies not addressed in the bill remain constant, the probable impact of implementing the provisions of the bill during each of the first five years following passage, in terms of daily demand on the adult correctional agencies, is estimated as follows:
