LEGISLATIVE BUDGET BOARD
Austin, Texas

CRIMINAL JUSTICE IMPACT STATEMENT

85TH LEGISLATIVE REGULAR SESSION

March 13, 2017

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
SB227 by Huffman (Relating to certain substances listed in Penalty Group 2 of the Texas Controlled Substances Act.), As Introduced

The provisions of the bill addressing felony sanctions are the subject of this analysis. The bill would amend the Health and Safety Code as it relates to certain substances listed in Penalty Group 2 of the Texas Controlled Substance Act. Under the provisions of the bill, a subsection of Penalty Group 2, specifically addressing substances approved by the Federal Drug Administration, would be repealed to align the Penalty Group with the other Penalty Groups within the Texas Controlled Substances Act.

This analysis assumes the provisions of the bill addressing felony sanctions would not result in a significant impact on the demand for state correctional resources.
