Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Finance was held on Monday, May 15, 2017, in the Capitol Extension, Room E1.036, at Austin, Texas.

The chair called the meeting to order at 10:05 AM. The following business was transacted:

 

The chair laid out HB 3198 and recognized the Senate sponsor, Senator Estes, to explain the bill.

 

Senator Nichols sent up a committee substitute.  The chair recognized Senator Estes to explain the difference between the committee substitute and the house bill as engrossed. 

 

Witnesses testifying and registering on the bill are shown on the attached list.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

The chair laid out HB 804 and recognized the Senate sponsor, Senator Taylor, Van  to explain the bill.

Senator Uresti moved that HB 804 do not pass but that CSHB 804 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 6 absent.

 

Senator Nichols moved that HB 2067 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 6 absent.

 

Senator West moved that HB 2277 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 6 absent.

 

Senator Bettencourt moved that HB 2475 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 6 absent.

 

Senator Nelson moved adoption of the committee substitute for HB 3198; without objection, it was so ordered.

 

Senator Birdwell moved that HB 3198 do not pass but that CSHB 3198 be reported back to the Senate with the recommendation that it do pass and be printed.  There being 7 ayes, 2 nays, 0 present not voting, and 6 absent, the motion failed to receive an affirmative vote of a majority of the membership of the Committee.

Senator Bettencourt moved that HB 3232 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 6 absent.

Senator Bettencourt moved that HB 3389 be reported favorably to the Senate with the recommendation that it do pass and be printed. There being 6 ayes, 1 nay, 1 present not voting, and 7 absent, the motion failed to receive an affirmative vote of a majority of the membership of the Committee.   

Senator Hancock moved that HB 3537 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 6 absent.

 

Senator Hancock moved that HB 4038 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 6 absent.

 

Having been on the prevailing side, Senator Nelson moved to reconsider the vote by which HB3389 failed to receive the affirmative vote of a majority of the membership of the Committee. There being no objection, it was so ordered.

 

Senator Bettencourt moved that HB 3389 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 6 absent.

 

Senator Nelson moved that all eligible bills be placed on the Local and Uncontested Calendar.  Without objection, it was so ordered.

 

Senator Taylor submitted a motion in writing asking to by shown voting aye on the following bills: HB 804, HB 2067, HB 2277, HB 2475, HB 3198, HB 3232, HB 3389, HB 3537 and HB 4038. 

 

There being no further business, at 10:54 AM Senator Nelson moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
