Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Natural Resources & Economic Development was held on Tuesday, April 25, 2017, in the Capitol Extension, Room E1.012, at Austin, Texas.

The chair called the meeting to order at 9:05 AM. There being a quorum present, the following business was transacted:

 

The following members arrived after the roll was called: Senator Sylvia Garcia, Senator Kelly Hancock, Senator Juan Hinojosa, Senator Don Huffines, and Senator Borris Miles.

 

The chair laid out SB 2098 and recognized the author, Senator Hall, to explain the bill. Senator Zaffirini sent up a committee substitute.  The chair recognized Senator Hall to explain the difference between the committee substitute and the senate bill as filed.

 

Witnesses testifying and registering on the bill are shown on the attached list.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Estes moved that SB 2098 be left pending; without objection, it was so ordered.

 

The chair laid out SB 908 and recognized the author, Senator Creighton, to explain the bill. Senator Zaffirini sent up a committee substitute. The chair recognized Senator Creighton to explain the difference between the committee substitute and the senate bill as filed.

Senator Estes moved that SB 908 be left pending; without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 1354 and the committee substitute, which

had been sent up at the April 18, 2017 hearing.

 

Senator Zaffirini moved adoption of the committee substitute; without objection, it was so ordered. Senator Zaffirini moved that SB 1354 do not pass but that CSSB 1354 be reported back to the Senate with the recommendation that it do pass and be printed. There being 5 ayes, 1 nay, 2 present not voting, and 3 absent, the motion failed to receive an affirmative vote of the majority of the committee membership.

 

Senator Taylor, Van moved to reconsider the vote by which CSSB 1354 failed to receive an affirmative vote of the majority of the committee membership; without objection, it was so ordered. Senator Zaffirini moved that SB 1354 do not pass but that CSSB 1354 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nays, 2 present not voting, and 1 absent. Senator Garcia submitted a motion in writing requesting unanimous consent to be shown voting aye on CSSB 1354; without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 1588 and the committee substitute, which had been sent up at the April 11, 2017 hearing.

 

Senator Estes moved that the committee substitute that had been sent up at the April 11, 2017 hearing be withdrawn; without objection, it was so ordered. Senator Huffines sent up a new committee substitute. The chair recognized Senator Huffines to explain the difference between the new committee substitute and the previous committee substitute.

 

Senator Huffines moved adoption of the new committee substitute; without objection, it was so ordered. Senator Huffines moved that SB 1588 do not pass but that CSSB 1588 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 2 nays, 0 present not voting, and 0 absent. Senator Hancock submitted a motion in writing requesting unanimous consent to be shown voting aye on CSSB 1588; without objection, it was so ordered. Senator Garcia submitted a motion in writing requesting unanimous consent to be shown voting nay on CSSB 1588; without objection, it was so ordered.

Senator Burton sent up a new committee substitute. The chair recognized Senator Burton to explain the difference between the new committee substitute and the previous committee substitute.

Senator Estes moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 2166. Senator Zaffirini moved that SB 2166 be reported favorably to the Senate with the recommendation that it do pass and be printed.

Senator Rodríguez moved that SB 568 do not pass but that CSSB 568 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 2 nays, 2 present not voting, and 1 absent. Senator Hancock submitted a motion in writing requesting unanimous consent to be shown voting nay on CSSB 568; without objection, it was so ordered.

 

Senator Huffines moved to reconsider the vote by which CSSB 1354 was reported favorably to the Senate; without objection, it was so ordered. Senator Zaffirini moved that SB 1354 do not pass but that CSSB 1354 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 0 nays, 3 present not voting, and 1 absent.

 

The chair laid out SB 2034 and recognized the author, Senator Miles, to explain the bill. Senator Miles sent up a committee substitute.  The chair recognized Senator Miles to explain the difference between the committee substitute and the senate bill as filed.
