Amend HB 1385 as follows:
(1) On page 2, between lines 6 and 7, insert a new SECTION, appropriately numbered to read as follows:
SECTION ____. Section 1202.003, Occupations Code, is amended by adding Subsection (e) to read as follows:
(e) Notwithstanding Subsection (d), an industrialized building does not include a building or structure in a chemical plant, petrochemical plant, refinery, natural gas plant, natural gas treating plant, pipeline, or oil and gas exploration and production operational setting that:
(1) is limited to persons employed by the owner, operator, or their authorized agents;
(2) has a foundation designed and stamped by a professional engineer;
(3) is verified as code compliant by a third-party professional engineer; and
(4) satisfies any applicable state, municipal, and local safety requirements.
(2) Renumber remaining sections appropriately.
