Amend Amendment No. 2 by Zedler to CSHB 1504 by striking page 1, lines 14 through 19, and substituting the following:
(2) On page 14, line 20, between "sanction" and the underlined period, insert the following:
if a violation of the Act or board rule has been established. But for any contested case hearings in which a final decision finds no sanctionable acts were established, and the board dismisses the case, the board shall remove any records of the complaint, related investigation, or temporary order, if any, from the licensee's profile within 10 business days. Any report of initial adverse action made to the National Practitioner Data Bank will also be voided within 10 business days on the basis of being overturned on appeal
