BACKGROUND AND PURPOSE

 

It has been reported that many elderly individuals who have had their driver's license surrendered or revoked are unaware of or unable to complete the procedures to obtain another form of identification. H.B. 345 seeks to address this issue by providing for the automatic issuance of a personal identification certificate to a person who is 60 years of age or older at the time the person's driver's license is surrendered or revoked.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 345 amends the Transportation Code to require the Department of Public Safety (DPS) to adopt procedures for the automatic issuance of a personal identification certificate to a person who is 60 years of age or older at the time the person's driver's license is surrendered or revoked. The bill requires the procedures to be in compliance with federal guidelines governing the issuance of identity documents and authorizes the procedures to require the person issued a personal identification certificate to update information previously provided to DPS when the person applied for an original driver's license.

 

EFFECTIVE DATE

 

September 1, 2019.
