AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
H.B. 515 amends current law relating to the establishment and operation of certain private family cemeteries.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 711.008(c), Health and Safety Code, to provide that Subsection (a) (relating to prohibiting certain entities from establishing or operating a cemetery or using any land for the interment of remains located in certain specified areas) does not apply to a private family cemetery that was established and operating on or before September 1, 2009, or is established and operating on land outside the boundaries of a municipality that has been owned or occupied by members of the same family for at least three generations and that is within 10 miles of the largest prison cemetery in this state.
SECTION 2. Effective date: September 1, 2019.
