AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Concerns have been raised regarding the extended waiting times some applicants face when seeking an assisted living facility license due to inspection delays. It has been suggested that an expedited process, such as that used to expedite certain safety inspections, would alleviate these delays for assisted living facility license applicants. H.B. 823 seeks to reduce wait times by providing for an expedited on-site health inspection process for such applicants.

 

H.B. 823 amends the Health and Safety Code to require the expedited inspection process for assisted living facilities implemented by rule of the executive commissioner of the Health and Human Services Commission to allow an applicant for an assisted living facility license or for a renewal of such a license to obtain an on-site health inspection not later than the 21st day after the date the request is made.

 

H.B. 823 amends current law relating to an expedited on-site health inspection process for assisted living facility license applicants.

 

RULEMAKING AUTHORITY

 

Rulemaking authority previously granted to the executive commissioner of the Health and Human Services Commission is modified in SECTION 2 (Section 241.0211, Health and Safety Code) of this bill.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends the heading to Section 247.0211, Health and Safety Code, to read as follows:

 

Sec. 247.0211.� EXPEDITED INSPECTION.

 

SECTION 2. Amends Section 247.0211(a), Health and Safety Code, to require the executive commissioner of the Health and Human Services Commission to adopt rules to implement an expedited inspection process that allows an applicant for an assisted living facility license or for a renewal of a license to obtain certain inspections including an on-site health inspection not later than the 21st day after the date the request is made.

 

SECTION 3. Effective date: September 1, 2019.
