BACKGROUND AND PURPOSE
Concerns have been raised regarding the extended waiting times some applicants face when seeking an assisted living facility license due to inspection delays. It has been suggested that an expedited process, such as that used to expedite certain safety inspections, would alleviate these delays for assisted living facility license applicants. C.S.H.B. 823 seeks to reduce wait times by providing for an expedited on-site health inspection process for such applicants.

CRIMINAL JUSTICE IMPACT
It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY
It is the committee's opinion that rulemaking authority is expressly granted to the executive commissioner of the Health and Human Services Commission in SECTION 2 of this bill.

ANALYSIS
C.S.H.B. 823 amends the Health and Safety Code to require the expedited inspection process for assisted living facilities implemented by rule of the executive commissioner of the Health and Human Services Commission to allow an applicant for an assisted living facility license or for a renewal of such a license to obtain an on-site health inspection not later than the 21st day after the date the request is made.
