AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

It has been noted that under current law, not all counties have the authority to regulate game rooms. It has been suggested that certain other counties, such as Upshur County, would benefit from having this regulatory authority to address local concerns with regard to the proliferation of game rooms near schools and churches. H.B. 1404 seeks to provide the authority to regulate game rooms to additional counties.

 

H.B. 1404 amends current law relating to the regulation of game rooms in certain counties.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 234.132, Local Government Code, as follows:

 

Sec. 234.132.� APPLICABILITY. Provides that this subchapter (Game Rooms) applies only to:

 

(1)�(7) makes no changes to these subdivisions;

 

(8)�(9) makes nonsubstantive changes to these subdivisions; and

 

(10) a county that has a population of less than 40,000 and is adjacent to:

 

(A) a county described by Subdivision (7) (relating to a county that is located on this state's border with Louisiana, has a population of more than 65,000, and is within 50 miles of a municipality in Louisiana with a population of more than 150,000); and

 

(B) a county described by Subdivision (8) (relating to a county with a population of more than 200,000 and less than 220,000).

 

SECTION 2. Effective date: September 1, 2019.
