AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 1435 amends current law relating to the inspection of a municipal solid waste management facility or site by the Texas Commission on Environmental Quality before a permit application is issued, amended, extended, or renewed.

 

RULEMAKING AUTHORITY

 

Rulemaking authority is expressly granted to the Texas Commission on Environmental Quality in SECTION 1 (Section 361.088, Health and Safety Code) of this bill.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 361.088, Health and Safety Code, by adding Subsection (h), as follows:

(h) Requires the Texas Commission on Environmental Quality (TCEQ), before a permit for a proposed municipal solid waste management facility is issued, amended, extended, or renewed, to inspect the facility or site used or proposed to be used to store, process, or dispose of municipal solid waste to confirm information included in the permit application. Requires TCEQ by rule to prescribe the kinds of information in a permit application that require confirmation under this subsection.

SECTION 2. Makes application of this Act prospective.�

 

SECTION 3. Effective date: September 1, 2019.
