AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
On April 15, 2016, Banquete High School senior Kollyn Gene Barton passed away after a rollover accident on his way to school on FM 666 in Nueces County. During the 85th Legislative Session, S.B. 312 was passed to designate a portion of FM 666 as the Kollyn Barton Memorial Highway. This bill merely seeks to add his middle name, Gene, to reflect his full name and be identified as Kollyn Gene Barton Memorial Highway.
H.B. 1605 amends current law relating to the designation of the Kollyn Barton Memorial Highway.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 225.129, Transportation Code, as follows:
Sec. 225.129. New heading: KOLLYN GENE BARTON MEMORIAL HIGHWAY. (a) Provides that the portion of Farm-to-Market Road 666 in Nueces County between its intersection with State Highway 44 and Farm-to-Market Road 624 is designated as the Kollyn Gene Barton Memorial Highway, rather than as the Kollyn Barton Memorial Highway.
(b) Requires the Texas Department of Transportation (TxDOT), subject to Section 225.021(c) (relating to prohibiting TxDOT from designing, constructing, or erecting a marker unless a grant or donation of funds is made to cover the cost), to:
(1) design and construct markers indicating the designation as the Kollyn Gene Barton Memorial Highway, rather than the Kollyn Barton Memorial Highway, and any other appropriate information; and
(2) Makes no change to this subdivision.
SECTION 2. Repealer: Section 225.124 (Kollyn Barton Memorial Highway), Transportation Code, as added by Chapter 1008 (H.B. 1317), Acts of the 85th Legislature, Regular Session, 2017, as duplicative of Section 225.129 (Kollyn Barton Memorial Highway), Transportation Code.
SECTION 3. Provides that to the extent of any conflict, this Act prevails over another Act of the 86th Legislature, Regular Session, 2019, relating to nonsubstantive additions to and corrections in enacted codes.
SECTION 4. Effective date: September 1, 2019.
