BACKGROUND AND PURPOSE

 

There are concerns about the burdens presented by the requirement that a person who holds an independent motor vehicle dealer's general distinguishing number and who purchases a certain amount of salvage vehicles per year must also hold a salvage vehicle dealer license. C.S.H.B. 1667 seeks to address these concerns by allowing for such a person to act as a salvage vehicle dealer or rebuilder without having to hold such a license.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

C.S.H.B. 1667 amends the Occupations Code to make statutory provisions relating to salvage vehicle dealers applicable to the holder of an independent motor vehicle dealer's general distinguishing number issued under the Transportation Code in the same manner as those provisions apply to a salvage vehicle dealer if the holder of the general distinguishing number acts as a salvage vehicle dealer or rebuilder or stores or displays a motor vehicle as an agent or escrow agent of an insurance company. The bill authorizes a person who holds such an independent motor vehicle dealer's general distinguishing number to act as a salvage vehicle dealer or rebuilder and to store or display a motor vehicle as such an agent.

September 1, 2019.
