BACKGROUND AND PURPOSE

Due to recent advances in stem cell research and other regenerative therapies, there have been calls to encourage the development of this area of medicine and to provide some oversight in the context of rapid commercial innovation. H.B. 1874 seeks to do so by renaming the Texas Adult Stem Cell Research Coordinating Board as the Texas Regenerative Medicine Coordinating Board and requiring the board to create a registry of regenerative medicine providers.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 1874 amends the Education Code to rename the Texas Adult Stem Cell Research Coordinating Board, Texas Adult Stem Cell Research Consortium, and adult stem cell research program, respectively, as the Texas Regenerative Medicine Coordinating Board, Texas Regenerative Medicine Consortium, and regenerative medicine program. The bill requires the Texas Regenerative Medicine Coordinating Board to establish and maintain a regenerative medicine registry that lists health care providers who provide regenerative therapy using stem cells and requires the Department of State Health Services to provide administrative support and services to the board as necessary for the board to establish and operate the registry.

EFFECTIVE DATE

September 1, 2019.

EXPLANATION OF AMENDMENTS

Committee Amendment No. 1

Committee Amendment No. 1 replaces a reference to stem cells in the requirement for the establishment and maintenance of a regenerative medical registry that lists health care providers who provide certain regenerative therapy with a reference to human cells, tissues, or cellular or tissue-based products as described by certain specified federal regulations.
