BACKGROUND AND PURPOSE

It has been suggested that obsolete and duplicative requirements for the Texas Water Development Board (TWDB) should be removed from statute. H.B. 1983 seeks to address this issue by repealing certain provisions relating to the duties of the TWDB.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 1983 repeals Water Code provisions that require the Texas Water Development Board (TWDB) to meet annually with the board of the Texas Department of Housing and Community Affairs (TDHCA) regarding colonias and the Colonia Initiatives Advisory Committee, that require the TWDB and the State Soil and Water Conservation Board to jointly conduct a water conservation study, and that require the TWDB to biennially submit to the legislature a written summary regarding certain compliance evaluations conducted to provide assistance to political subdivisions for water supply projects.

H.B. 1983 amends the Government Code to make a related change regarding the joint meeting of the governing board of the TDHCA and the TWDB at which the Colonia Initiatives Advisory Committee is required to present an update and make recommendations regarding certain colonia matters.

H.B. 1983 repeals the following provisions of the Water Code:

· Section 6.060(d)

· Section 16.022

· Section 17.1245(b)
