AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 1992 amends current law relating to prohibiting telemarketers from transmitting misleading caller identification information or otherwise misrepresenting the origin of a telemarketing call.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 304.151, Business & Commerce Code, by amending Subsection (b) and adding Subsection (c), as follows:

 

(b) Prohibits a telemarketer from:

 

(1) and (2) makes nonsubstantive changes to these subdivisions; or

 

(3) causing misleading information to be transmitted to a recipient�s caller identification service or device or otherwise misrepresenting the origin of a telemarketing call.

 

(c) Provides that a telemarketer does not violate Subsection (b)(3) if the telemarketer substitutes the name and telephone number of the person on whose behalf the call is made for the telemarketer�s name and telephone number.

 

SECTION 2. Effective date: September 1, 2019.
