AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

C.S.H.B. 2103 amends current law relating to a prohibition on contractors acting as public insurance adjusters in certain circumstances.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends the heading to Section 4102.163, Insurance Code, to read as follows:

 

Sec. 4102.163. CERTAIN CONTRACTOR BUSINESS PROHIBITED.

 

SECTION 2. Amends Section 4102.163(a), Insurance Code, as follows:

 

(a) Prohibits a contractor, rather than a roofing contractor, from acting as a public adjuster or advertising to adjust claims for any property for which the contractor is providing or may provide contracting services, rather than roofing services, regardless of whether the contractor:

 

(1) creates this subdivision from existing text and makes a nonsubstantive change; or

 

(2) is authorized to act on behalf of the insured under a power of attorney or other agreement.

 

SECTION 3. Effective date: September 1, 2019.
