AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
It has been noted that a physician is already allowed to delegate to a pharmacist the ability to implement or modify a patient's drug therapy under a protocol if the pharmacist practices in certain health care facilities. H.B. 2425 seeks to allow a physician to delegate this same authority to pharmacists working in federally qualified health centers.
H.B. 2425 amends current law relating to the authority of physicians to delegate to certain pharmacists the implementation and modification of a patient's drug therapy.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 157.101, Occupations Code, by amending Subsection (b-1) and adding Subsection (g), as follows:
(b-1) Adds pharmacists practicing at a federally qualified health center to a list of pharmacists to whom a delegation under Subsection (b) (relating to authorizing a physician to delegate to certain pharmacists the performance of specific acts of drug therapy management authorized by the physician through certain orders) may include the implementation or modification of a patient's drug therapy under a protocol. Makes conforming changes.
(g) Defines "federally qualified health center."
SECTION 2. Effective date: September 1, 2019. �
