BACKGROUND AND PURPOSE

 

There have been calls to allow a municipality to expand the boundaries of an existing crime control and prevention district within the municipality's extraterritorial jurisdiction. C.S.H.B. 2445 seeks to address this issue by authorizing a municipality that created a crime control and prevention district to add all or part of the territory in the municipality's extraterritorial jurisdiction to the district.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

C.S.H.B. 2445 amends the Local Government Code to authorize a municipality that created a crime control and prevention district to add all or part of the territory in the municipality's extraterritorial jurisdiction to the district and to authorize the district to impose a tax in that territory but only if the addition of the territory and the imposition of the tax are approved by a majority of the qualified voters of the territory to be added voting at an election held for that purpose.

September 1, 2019.
