AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 2546 amends current law relating to the energy efficiency performance standards for construction of industrialized housing.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subchapter D, Chapter 1202, Occupations Code, by adding Section 1202.1536, as follows:

 

Sec. 1202.1536. OPTION TO CONSTRUCT IN ACCORDANCE WITH CERTAIN ENERGY EFFICIENCY PERFORMANCE STANDARDS. Authorizes a manufacturer or builder of industrialized housing, notwithstanding any other provision of this subchapter (Requirements and Standards For Industrialized Housing and Buildings), to construct industrialized housing in accordance with the energy efficiency performance standards outlined in:

 

(1) the energy code described by Section 388.003(a) (relating to adopting certain provisions of the International Residential Code as the energy code in this state for certain construction and authorizing the State Energy Conservation Office to adopt and substitute later editions of that code), Health and Safety Code; or

 

(2) a local amendment to the energy code described by Section 388.003(a), Health and Safety Code, that is:

 

(A) applicable to the municipality or county in which the industrialized housing will be located; and

 

(B) determined by the laboratory, as defined by Section 388.002 (Definitions), Health and Safety Code, to be equally or more stringent than the energy code described by Subdivision (1).

 

SECTION 2. Effective date: September 1, 2019.
