AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

C.S.H.B. 2546 amends current law relating to the energy efficiency performance standards for construction of certain industrialized housing.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subchapter D, Chapter 1202, Occupations Code, by adding Section 1202.1536, as follows:

 

Sec. 1202.1536. OPTION TO CONSTRUCT CERTAIN INDUSTRIALIZED HOUSING IN ACCORDANCE WITH CERTAIN ENERGY EFFICIENCY PERFORMANCE STANDARDS. (a) Authorizes a manufacturer or builder of industrialized housing, notwithstanding any other provision of this subchapter (Requirements and Standards for Industrialized Housing and Buildings) related to energy efficiency performance standards, to construct single-family industrialized housing in accordance with the energy efficiency performance standards outlined in:

 

(1) the energy code adopted by the Texas Industrialized Building Code Council; or

 

(2) the energy code in this state for single-family residential construction with any local amendments or alternative compliance paths described by Section 388.003 (Adoption of Building Energy Efficiency Performance Standards), Health and Safety Code, that are:

 

(A) requested by a municipality, county, or group of counties located in the climate zone in which the single-family industrialized housing will be located; and

 

(B) determined by the laboratory, as defined by Section 388.002 (Definitions), Health and Safety Code, to be equally or more stringent than the energy code described by Section 388.003(a) (relating to the adoption of the energy efficiency chapter of the International Residential Code), Health and Safety Code.

 

(b) Requires a manufacturer or builder of industrialized housing to maintain and, on request, make available to Texas Department of Licensing and Regulation, to a design review agency, or to another entity authorized to evaluate industrialized housing under this chapter (Industrialized Housing and Building) all documentation necessary to evaluate single-family industrialized housing constructed by the manufacturer or builder in accordance with the energy efficiency performance standards described by Subsection (a).

 

SECTION 2. Effective date: September 1, 2019.
