AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 2569 amends current law relating to requirements for condominium plats or plans.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Sections 82.059(b) and (d), Property Code, as follows:

 

(b) Requires each plat to show:

 

(1)�(6) makes no changes to these subdivisions;

 

(7) the location of horizontal unit boundaries, if any, with reference to established data, unless described in the declaration or shown or projected on recorded plans, and the unit's identifying number, rather than the location, with reference to established data, of any horizontal unit boundaries not shown or projected on recorded plans and the unit's identifying number; and

 

(8)�(12) makes no changes to these subdivisions.

 

(d) Requires plans, to the extent not shown on the plats, to show:

 

(1) makes no changes to this subdivision;

 

(2) the horizontal unit boundaries, if any, with reference to established data, unless described in the declaration, and the unit's identifying number, rather than the horizontal unit boundaries, with reference to established data, and the unit's identifying number; and

 

(3) makes no changes to this subdivision.

 

SECTION 2. Makes application of this Act prospective. �

 

SECTION 3. Effective date: September 1, 2019.
