Committee Report (Unamended)

BACKGROUND AND PURPOSE

Concerns have been raised regarding the complexity and expenses of the condominium project approval process, as that process applies to detached condominiums. H.B. 2569 seeks to address some of these concerns relating to the compliance of certain planning documents by specifying which horizontal unit boundaries the condominium plats and plans must describe.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 2569 amends the Property Code to exclude horizontal unit boundaries described in a condominium declaration from the horizontal unit boundaries whose location with reference to established data must be shown on the condominium plats or plans.
