AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

It has been noted that vehicle inspection stations in many counties across Texas are limited in the number of vehicle inspections they may provide if they are granted a low emission waiver for performing inspections using the onboard diagnostic system of the vehicle. H.B. 2604 seeks to remove this limitation.

 

H.B. 2604 amends current law relating to the number of emissions inspections performed by certain vehicle inspection stations.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 548.3075(b), Transportation Code, as follows:

 

(b) Prohibits a Department of Public Safety of the State of Texas (DPS) rule that allows an inspection station to perform a limited emissions inspection of a motor vehicle from restricting the number of limited emissions inspections conducted by the station, rather than prohibiting a DPS rule that allows a qualified inspection station to perform a limited emissions inspection of a motor vehicle from restricting the station to fewer than 150 inspections per month.

 

SECTION 2. Effective date: January 1, 2020.
