AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Inconsistencies exist in statute related to the brakes required for trailers, semitrailers, or pole trailers. H.B. 2810 addresses these inconsistencies by stating that trailers, semitrailers, or pole trailers will require emergency brakes if they weigh over 4,500 pounds.

 

H.B. 2810 amends current law relating to exempting certain trailers from being equipped with emergency brakes.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 547.405(d), Transportation Code, as follows:

 

(d) Requires a trailer, semitrailer, or pole trailer that is equipped with air or vacuum brakes or that has a gross weight heavier than 4,500 pounds, rather than 3,000 pounds, to be equipped with brakes that:

 

(1) operate on all wheels required to have brakes under Section 547.402 (Operation and Maintenance of Brakes), rather than operate on all wheels; and

 

(2) makes no changes to this subdivision.

 

SECTION 2. Makes application of this Act prospective. Provides that, for purposes of this section, an offense was committed before the effective date of this Act if any element of the offense occurred before that date.

 

SECTION 3. Effective date: September 1, 2019.
