BACKGROUND AND PURPOSE

 

It has been suggested that certain statutory requirements relating to the brakes of trailers, semitrailers, and pole trailers are inconsistent. H.B. 2810 seeks to address this inconsistency by excepting certain trailers from the requirement to be equipped with emergency brakes.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 2810 amends the Transportation Code to except a trailer, semitrailer, or pole trailer with a gross vehicle weight under 4,500 pounds from the requirement to be equipped with emergency brakes that operate on all wheels of the vehicle by increasing the minimum weight threshold determining whether such a requirement applies.                             

 

EFFECTIVE DATE

 

September 1, 2019.
