AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

In an effort to increase project efficiency in the design-build process for state highway projects, H.B. 2830 would revise certain requirements and provide the Texas Department of Transportation with additional flexibility in scheduling these projects.

 

H.B. 2830 would change the current restriction of three design-build projects per fiscal year to allow for a total of six design-build contracts per fiscal biennium.

 

H.B. 2830 would also require a project design to be 30 percent complete before submitting a request for proposal.

 

H.B. 2830 amends current law relating to certain requirements for and limitations on design‑build contracts for highway projects of the Texas Department of Transportation.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 223.242(d-1), Transportation Code, as follows:

 

(d-1) Prohibits the Texas Department of Transportation (TxDOT) from entering into more than six contracts under this section (Scope of and Limitation on Contracts) in each state fiscal biennium, rather than prohibiting TxDOT from entering into more than three contracts under this section in each fiscal year.

 

SECTION 2. Amends Section 223.246(a), Transportation Code, as follows:

 

(a) Requires a request for proposals to include:

 

(1)�(4) makes no changes to these subdivisions;

 

(5) a design approximately 30 percent complete, rather than a schematic design approximately 30 percent complete; and

 

(6)�(14) makes no changes to these subdivisions.

 

SECTION 3. Makes application of Section 223.246(a), Transportation Code, as amended by this Act, prospective.

 

SECTION 4. Effective date: September 1, 2019.
