AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Interested parties have raised concerns that there are no requirements for animal shelters to provide notification to individuals that have recently adopted an animal from the shelter following the outbreak of a disease. To address this issue, H.B. 3092 would ensure that adopters of pets from shelters were fully informed of any disease outbreaks and potential health problems in their pets. To accomplish this goal, the bill would require an animal shelter to notify each person who adopted an animal of an epizootic infectious disease as defined in the Health and Safety Code that occurred among animals in the shelter 15 days before or after the adoption. This notification can be submitted in a manner determined by the shelter.

 

H.B. 3092 amends current law relating to notice of an epizootic infectious disease occurring in an animal shelter.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Chapter 823, Health and Safety Code, by adding Section 823.004, as follows:

 

Sec. 823.004. REQUIRED NOTICE OF EPIZOOTIC INFECTIOUS DISEASES. (a) Defines "epizootic."

 

(b) Requires an animal shelter to provide written, electronic, or telephonic notice to each person who adopts an animal from the shelter of any epizootic infectious disease that occurs among the animals in the shelter within the 15-day period:

 

(1) before the date the person adopts the animal; or

 

(2) after the date the person adopts the animal.

 

(c) Provides that Section 823.009 (Civil Penalty) does not apply to this section.

 

SECTION 2. Effective date: September 1, 2019.
