BACKGROUND AND PURPOSE

 

It has been suggested that the authority for certain counties to collect interest on an assessment for properties benefiting from the upgrade of a road not previously maintained by the county is too narrow in scope. C.S.H.B. 4251 seeks to address this issue by expanding the counties to which this authority applies. 

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

C.S.H.B. 4251 amends the Transportation Code to authorize the Commissioners Court of Bastrop County to require the payment of interest, at the postjudgment interest rate determined by the consumer credit commissioner, on an assessment of costs for the construction or repair of a road in a subdivision or of an access road to a subdivision.

 

EFFECTIVE DATE

 

On passage, or, if the bill does not receive the necessary vote, September 1, 2019.

While C.S.H.B. 4251 may differ from the original in minor or nonsubstantive ways, the following summarizes the substantial differences between the introduced and committee substitute versions of the bill.
