BACKGROUND AND PURPOSE

 

It has been suggested that the extension of the term of the comprehensive development agreement for the State Highway 130 project from U.S. Highway 183 to Interstate Highway 10 (Segments 5 and 6) could facilitate easing traffic congestion and improving overall mobility. H.B. 4427 seeks to address this issue by authorizing the Texas Department of Transportation to amend such an agreement in order to extend its term.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 4427 amends the Transportation Code to authorize the Texas Department of Transportation to amend a comprehensive development agreement with a private participant entered into on or before March 22, 2007, for State Highway 130 from U.S. Highway 183 to Interstate Highway 10 (Segments 5 and 6) to extend the term of the comprehensive development agreement for an additional period capped at 20 years if the amendment outlines the benefit the state will receive from extending the term.
