AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 4584 amends current law relating to sale of returnable containers and creates a criminal offense.

 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends the heading to Chapter 204, Business & Commerce Code, to read as follows:

 

CHAPTER 204. SALE OF RETURNABLE CONTAINER

 

SECTION 2. Amends Section 204.001, Business & Commerce Code, as follows:

 

Sec. 241.001. DEFINITIONS. Provides that in this chapter:

 

(1) Deletes the definition for "plastic bulk merchandise container," redesignates existing Subdivision (2) as Subdivision (1), and makes no further changes.

 

(2) Defines "returnable container."

 

SECTION 3. Amends the heading to Section 204.002, Business & Commerce Code, to read as follows:

 

Sec. 204.002. REQUIREMENTS APPLICABLE TO SALE OF RETURNABLE CONTAINER.

 

SECTION 4. Amends Sections 204.002(a) and (c), Business & Commerce Code, to replace references to plastic bulk merchandise containers with references to returnable containers.

 

SECTION 5. Amends Section 204.003(a), Business & Commerce Code, to replace references to plastic bulk merchandise containers with references to returnable containers.

 

SECTION 6. Amends Sections 204.005(a) and (b), Business & Commerce Code, to replace references to plastic bulk merchandise containers with references to returnable containers.

 

SECTION 7. Makes application of this Act prospective. Provides that, for purposes of this section, an offense was committed before the effective date of this Act if any element of the offense occurred before that date.

 

SECTION 8. Effective date: September 1, 2019.
