BACKGROUND AND PURPOSE

 

It has been noted that the City of Conroe has indicated an interest in annexing the land encompassing the Montgomery County Municipal Utility District No. 147 into the city's corporate limits. However, there are concerns that such annexation would result in the dissolution of the district, making planned development in the district unfeasible. H.B. 4649 seeks to ensure that the district is not dissolved upon annexation.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 4649 amends the Special District Local Laws Code to establish that the Montgomery County Municipal Utility District No. 147 retains all of its outstanding debt and obligations and is not dissolved if all or any part of its territory is annexed by the City of Conroe into the city's corporate limits.

 

EFFECTIVE DATE

 

On passage, or, if the bill does not receive the necessary vote, September 1, 2019.
