AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
It has been noted that the owners of certain territory in Sutton County that is not in the territory of the Sutton County Underground Water Conservation District have indicated their desire to have their territory included in the district and that the district has indicated its support for the inclusion. H.B. 4705 seeks to address this issue by revising provisions relating to the district's territory.
H.B. 4705 amends the Special District Local Laws Code to remove the exemption of specified territory from inclusion in the Sutton County Underground Water Conservation District.
H.B. 4705 amends current law relating to the territory of the Sutton County Underground Water Conservation District.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 8886.051, Special District Local Laws Code, as follows:
Sec. 8886.051. DISTRICT TERRITORY. Provides that the boundaries of the Sutton County Underground Water Conservation District (district) are coextensive with the boundaries of Sutton County, rather than providing that the district is composed of the territory in Sutton County, other than the territory in Sections 60, 67, and 90, Block No. A, HE&WTRyCoSurvey, Sutton County, unless the district's territory has been modified under:
(1)�(2) makes no changes to these subdivisions.
SECTION 2. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.
SECTION 3. Effective date: September 1, 2019.
