BACKGROUND AND PURPOSE
It has been suggested that the legislature should be able to act on legislation continuing a state agency or affiliated entity that is subject to abolishment under the Texas Sunset Act at any point during the legislative session, without regard to the 60-day waiting period for non-emergency items. H.J.R. 79 seeks to amend the Texas Constitution to provide the legislature that authority.

It is the committee's opinion that this resolution does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

It is the committee's opinion that this resolution does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS
H.J.R.79 proposes an amendment to the Texas Constitution to authorize the state legislature, at any time during a regular session, to act on any bill that extends the existence of an agency, commission, or advisory committee following legislative review.

ELECTION DATE
The constitutional amendment proposed by this joint resolution will be submitted to the voters at an election to be held November 5, 2019.
