BACKGROUND AND PURPOSE

 

It has been suggested that a state agency or political subdivision should be able to transfer a law enforcement animal, which may otherwise be classified as salvage or surplus property to be auctioned off for a fee upon retirement, to the animal’s handler or other qualified caretaker for no fee on the animal’s retirement or other time in the animal’s best interest. H.J.R. 96 proposes a constitutional amendment to authorize the legislature to provide that authority.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this resolution does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this resolution does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.J.R. 96 proposes an amendment to the Texas Constitution to authorize the legislature to authorize a state agency or a political subdivision to transfer a law enforcement dog, horse, or other animal to the animal's handler or another qualified caretaker for no consideration on the animal's retirement or at another time if the transfer is in the animal's best interest.

 

ELECTION DATE

 

The constitutional amendment proposed by this joint resolution will be submitted to the voters at an election to be held November 5, 2019.
