BACKGROUND AND PURPOSE
It has been noted that certain counties, such as Fort Bend County, do not currently have statutory authority to enact a park use rule. C.S.S.B. 286 seeks to extend to more counties the authority to enact such a rule.

CRIMINAL JUSTICE IMPACT
It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS
C.S.S.B. 286 amends the Local Government Code to expand the applicability of provisions authorizing certain counties to enact a park use rule the violation of which is subject to certain penalties to include a county with a population of 580,000 or more adjacent to a county with a population of 2.8 million or more. The bill prohibits a board of park commissioners created for such a county from adopting a park use rule relating to the use of fireworks.
