AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The City of Denton has seen extraordinary growth over the last decade. In an effort to improve the tourism industry and the city's ability to compete with its neighbors for events, S.B. 386 authorizes the City of Denton to create a Tourism Public Improvement District. This will be a limited district authorized to only use funds for the use of special supplemental services for improvement and promotion of the district, including services relating to advertising, promotion, health and sanitation, water and wastewater, public safety, security, business recruitment, development, recreation, and cultural enhancement.

 

As proposed, S.B. 386 amends current law relating to a common characteristic or use project in a public improvement district in certain municipalities.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 372.0035, Local Government Code, by amending Subsection (a) and by adding Subsection (e), as follows:

 

(a) Provides that this section applies only to certain municipalities, including a municipality that has a population of more than 100,000 and less than 125,000 and is wholly located in a county with a population of more than 650,000. Makes a nonsubstantive change.

 

(e) Authorizes a municipality described by Subsection (a)(1)(c) to undertake a project under this section only for a purpose described by Section 372.003(b)(13) (relating to special supplemental services for improvement and promotion of the district).

 

SECTION 2. Effective date: September 1, 2019.
