AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

In 2017, the 85th Texas Legislature passed legislation to create the Southwestern Travis County Groundwater Conservation District. The legislation that created the district required a confirmation election to confirm the creation of the district. However, this legislation established the uniform election date of May 2018 as the date to hold the confirmation election.

 

Because this date was cost prohibitive to hold the election, the confirmation election has yet to be held.

 

S.B. 669 would establish the uniform election date in November 2019 as the date to hold the confirmation election to reduce costs. (Original Author's/Sponsor's Statement of Intent)

 

S.B. 669 amends current law relating to the date for the confirmation election for the Southwestern Travis County Groundwater Conservation District.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 8871.024(a) and (e), Special District Local Laws Code, as follows:

 

(a) Requires the temporary directors to order an election in the district, to be held not later than the uniform election date in November 2019, rather than May 2018, to confirm the creation of the district and to elect the initial directors.

 

(e) Requires temporary directors elected under this subsection to order a subsequent election to be held to confirm the creation of the district and to elect the initial directors not earlier than the uniform election date in November 2020, rather than May 2020.�

 

SECTION 2. Effective date: upon passage or September 1, 2019.
