BILL ANALYSIS

S.B. 1083

By: Zaffirini

Land & Resource Management

Committee Report (Unamended)

BACKGROUND AND PURPOSE

Concerns have been raised that the formula used to determine the amount of compensation provided to an emergency services district by a municipality annexing and removing territory from the district does not fully reflect revenue lost by the district. S.B. 1083 seeks to address this issue by providing for a formula that takes into account a district's retail sales and use tax revenue.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

S.B. 1083 amends the Health and Safety Code to require a municipality that removes territory from an emergency services district that the municipality has annexed to compensate the district according to a formula provided by the bill that takes into account the district's retail sales and use tax revenue if that formula yields a greater amount than the formula prescribed by statute.

S.B. 1083 amends the Special District Local Laws Code to make conforming changes.

EFFECTIVE DATE

September 1, 2019.
