BACKGROUND AND PURPOSE

 

It has been noted that under current law the criminal history that makes a person explicitly ineligible to serve on a public school district board is limited to a conviction for certain prostitution offenses. S.B. 2283 seeks to expand that disqualifying criminal history to include any felony offense.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

S.B. 2283 amends the Education Code to expand the criminal history that makes a person ineligible to serve as a member of the board of trustees of a public school district from the person's conviction for a certain prostitution offense to the person's conviction of or plea of guilty or nolo contendere to such an offense or the person's conviction of or plea of guilty or nolo contendere to any felony offense.
