A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to reports by the Texas Commission on Environmental |
|
Quality about dams that have certain hazard classifications. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 12.052, Water Code, is amended by adding |
|
Subsection (e-3) to read as follows: |
|
(e-3) For purposes of this subsection, the emergency |
|
management director for a political subdivision is the person |
|
designated the subdivision's emergency management director by |
|
Section 418.1015, Government Code. The commission shall provide a |
|
report of a dam that has a hazard classification of high or |
|
significant to the emergency management director for the political |
|
subdivision in which the dam is located. The commission shall make a |
|
report to the emergency management director not later than: |
|
(1) the 48th hour after the time of the designation of |
|
a dam as a high hazard classification; or |
|
(2) the 30th day after the date of the designation of a |
|
dam as a significant hazard classification. |
|
SECTION 2. For each dam that, as of the effective date of |
|
this Act, the executive director of the Texas Commission on |
|
Environmental Quality maintains a classification of high or |
|
significant hazard, the commission shall provide a report regarding |
|
the hazard classification of the dam to the emergency management |
|
director for the political subdivision in which the dam is located |
|
as provided by Section 12.052(e-3), Water Code, as added by this |
|
Act. Each report must be provided as soon as practicable and not |
|
later than March 1, 2020. |
|
SECTION 3. This Act takes effect September 1, 2019. |
