A BILL TO BE ENTITLED
 
AN ACT
  relating to reports by the Texas Commission on Environmental
  Quality about dams that have certain hazard classifications.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 12.052, Water Code, is amended by adding
  Subsection (e-3) to read as follows:
         (e-3)  For purposes of this subsection, the emergency
  management director for a political subdivision is the person
  designated the subdivision's emergency management director by
  Section 418.1015, Government Code. The commission shall provide a
  report of a dam that has a hazard classification of high or
  significant to the emergency management director for the political
  subdivision in which the dam is located. The commission shall make a
  report to the emergency management director not later than:
               (1)  the 48th hour after the time of the designation of
  a dam as a high hazard classification; or
               (2)  the 30th day after the date of the designation of a
  dam as a significant hazard classification.
         SECTION 2.  For each dam that, as of the effective date of
  this Act, the executive director of the Texas Commission on
  Environmental Quality maintains a classification of high or
  significant hazard, the commission shall provide a report regarding
  the hazard classification of the dam to the emergency management
  director for the political subdivision in which the dam is located
  as provided by Section 12.052(e-3), Water Code, as added by this
  Act. Each report must be provided as soon as practicable and not
  later than March 1, 2020.
         SECTION 3.  This Act takes effect September 1, 2019.
