        |  | A BILL TO BE ENTITLED | 
      
        |  | AN ACT | 
      
        |  | relating to the recording of certain personal information of voters | 
      
        |  | by election officials. | 
      
        |  | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | 
      
        |  | SECTION 1.  Chapter 63, Election Code, is amended by adding | 
      
        |  | Section 63.0015 to read as follows: | 
      
        |  | Sec. 63.0015.  RECORDED DOCUMENTATION OF CERTAIN PERSONAL | 
      
        |  | INFORMATION.  (a)  An election officer may copy documentation | 
      
        |  | presented by a voter under Section 63.001(b) or record information | 
      
        |  | from the documentation. | 
      
        |  | (b)  An election officer may photograph the entire face of a | 
      
        |  | voter who is accepted for voting under this chapter if: | 
      
        |  | (1)  the documentation presented by a voter under | 
      
        |  | Section 63.001(b) is not documentation issued by the Department of | 
      
        |  | Public Safety containing the person's photograph; or | 
      
        |  | (2)  the election official questions the authenticity | 
      
        |  | of the documentation presented by a voter under Section 63.001(b), | 
      
        |  | regardless of whether the documentation is issued by the Department | 
      
        |  | of Public Safety and contains the person's photograph. | 
      
        |  | (c)  A voter may only be photographed under this section | 
      
        |  | while being accepted for voting and may not be photographed while | 
      
        |  | the voter is occupying a voting station. | 
      
        |  | (d)  Information copied or recorded under this section, | 
      
        |  | including a photograph produced under Subsection (b), is | 
      
        |  | confidential except for use in a criminal investigation or | 
      
        |  | prosecution or a civil court proceeding. | 
      
        |  | (e)  All information collected under this section shall be | 
      
        |  | provided to the secretary of state for election-related purposes. | 
      
        |  | SECTION 2.  This Act takes effect September 1, 2019. |
